The Referral Program Terms are in addition to any agreements between you and Capital One, including the Capital One Terms of Service, as applicable (collectively, the “Referral Terms”). The Referral Terms are incorporated by reference and shall apply to your participation in the Refer a Friend Program (“Referral Program”), including, if necessary, to resolve any disputes between you and Capital One related to or arising out of the Referral Program. 

Eligibility 

• The Referral Program is open to primary account holders with an open eligible Capital One card in good standing (e.g., not suspended, restricted, delinquent, or otherwise in default).
• You will not be able to access the Referral Program through the mobile app unless you are using the most up-to-date version of the mobile app.
• When you share your referral link, you will reveal that you have a product with Capital One.
• Referral Program offers are not available if you are a Capital One call center employee or an employee of Capital One Bank branches or Cafés. 

Process 

• You may refer a Friend with a link we send to you or that you retrieve through your login to online banking.
• You may send the link to a Friend through email, text message, or other means you choose by copying the referral link and sharing it yourself. 
• Capital One may pre-populate a message if you choose to send the referral link by email or text message, but you have the ability to edit the entire message before sending and must send the message. 
• By participating in the Referral Program, you represent and warrant that you have the necessary rights, permissions, and consents from Friends to send them the referral link by email, text message or other means. 

Bonus Fulfillment 

• Referral offers and referrals bonuses are individual to you and cannot be transferred or redeemed for cash.
• You can refer Friends and family to Capital One at any time, but referral bonus amounts are individual offers which are only available for a limited time.
• In order to receive a referral bonus: (1) Your Friend must use the referral link you sent them, and complete the application process through that link for you to receive a bonus. (2) Your Friend must open an account for a Capital One card. (3) Your Friend must be a new Capital One card customer. This means they cannot have a Capital One Consumer Branded or Small Business card currently open for which they are the Primary account holder. (4) Your account must be open and in good standing to receive a bonus. 
• If your Friend opens a Secured Card Account, they must make their minimum required security deposit to open an account.
• It may take up to 8 weeks after a Friend opens an account to see a referral bonus reflected in your account. 
• Bonuses count toward the maximum bonus for the year in which you receive the bonuses and not when you made the referral.
• If the bonus you earn from the Referral Program exceeds the maximum allowable bonus, you may receive a bonus in a partial amount to keep the total bonus for the calendar year at the maximum allowable bonus amount. 
• Bonus may be subject to tax-related reporting for the year you receive it, we may be required to send you, and file with the IRS, Form 1099-MISC. Please consult with a tax advisor for questions about the impact of this form. 

Rules and Restrictions

• If you upgrade or change your account to another Capital One card after you have shared the link, or while any referred application or bonus is pending, you will not be eligible for a referral bonus. 
• If you have other Capital One credit card accounts that are not in good standing, you may not be eligible for the Referral Program.
• Spamming, harassment, misrepresentations in connection with the Referral Program, and fraudulent activity are prohibited. By participating in the Referral Program, you agree to remain in compliance with all applicable laws, including laws governing commercial emails and telemarketing.  

Additional terms

• We reserve the right to alter, change or terminate the Referral Program at any time, and if offered, a welcome offer for your Friend may vary.
• We reserve the right to disqualify you from participation in the Referral Program in the event of fraud, abuse of program privileges, or violation of the Terms as determined at our discretion. Such termination may result in forfeiture of any accumulated referral bonuses. 
• Account closure or suspension may result in the loss of any referral bonuses that haven’t been applied to your account yet. 
• We reserve the right to delay or not enforce any of our rights under the Referral Program without waiving or losing our right to enforce them later.
